Two siblings may start a dispute about anything and make it a huge issue. When things get out of hand, people sometimes end up in jail for assaulting their siblings. But have you ever considered locking up your brother for hurling a glass of water at you? A Florida man charged with throwing two glasses of water on his older brother faces up to 30 years in prison.
According to a report by Law & Crime of the court documents, 64-year-old David Sherman Powelson, a resident of Lee County, Florida, was detained on February 22 and charged with one count of first-degree felony aggravated violence. He and his older brother, who was around 65 years old, got into a dispute over Key Lime Pie.
If the victim is above 65 years old, Florida reclassifies aggravated battery from a second-degree felony to a first-degree felony. According to Powelson, he ate a slice of pie that his older brother had been saving for later, which caused them to argue. The younger brother then allegedly threw two glasses of water at the older brother.
According to the probable cause affidavit, officers from the Lee County Sheriff’s Office responded to a 911 call from a residence in the county’s West District at around 8:33 p.m. on February 15. The call was regarding a “physical domestic altercation” between Powelson and his older brother, the identity of whom is unknown.
At about 8:45 p.m., a deputy came to the home and spoke with Powelson’s elder sibling, who was described in the affidavit as “the victim.” The affidavit stated that after Powelson consumed a slice of the Key lime pie, “the victim became irritated and an altercation followed. David [Powelson] dumped two huge glasses of water over the victim while seated on the chair. The victim was concerned that [Powelson’s] violent behavior might result in physical injury or perhaps death to him.”
The paper indicated that when queried about the event, Powelson told the deputy that his brother had left a Key lime pie in the refrigerator for several days and never ate it. Then Powelson ate it himself, and the two brothers got into a dispute about the pie.
