Avery McMillan, 20, of Bloomington, Indiana, was found dead inside a house two weeks earlier. On Wednesday, August 31, authorities made the homeowner the subject of an arrest in connection with her passing. According to arrest documents, 33-year-old Eric Montgomery is currently accused of providing alcohol to a juvenile while also being charged with rape while the victim is mentally unable or incompetent. Since McMillan’s mysterious death on August 17, 2022, only this arrest has taken place.
In the 4100 block of Arlington Road, adjacent to State Road 46 and North Maple Grave Road, deputies from the Monroe County Sheriff’s Department were called to a residence off-campus at 9.45 a.m. on that day. They discovered Valparaiso resident McMillan there, who was unconscious and unresponsive. The deputies administered three Narcan dosages, however they were unsuccessful in reviving the woman. She was reportedly found in the room of 33-year-old Eric, who resided at his parents’ home, according to court documents.
According to police, Montgomery cooperated with them at the time by informing agents that he had met McMillan the day before, picked her up close to the university, and taken her to his house nearby. The time between when McMillan was picked up and when she passed away the next morning was not made public by the authorities.
Police are now awaiting test results from a medical examiner to identify the precise cause of McMillan’s death, even though the use of Narcan suggests that she may have died from an overdose. The officials said that it might take a month before the results are made public.
Montgomery was apprehended peacefully during a routine traffic stop on Wednesday, despite the fact that the police claim he has a “violent and long criminal history.” The Critical Incident Response Team, a specialised component of the Monroe County Sheriff’s Office, reportedly assisted in the arrest.
A judge ordered Montgomery’s arrest on a warrant on Tuesday for rape with a “disabled or defective” victim and providing alcohol to a juvenile, according to court documents, and set his bail at $100,000.
The most recent arrest for marijuana possession for Montgomery in Indiana occurred on August 4, 2022. According to records, Montgomery’s criminal arrest history includes charges for domestic abuse in 2018, burglary and credit card theft in 2012, endangering a person while driving drunk in 2019, and distributing a counterfeit substance in 2011.
McMillan’s friends and relatives have already shared their memories of her on social media, praising her for being “so generous” and “always there,” according to a GoFundMe put up by Gabrielle Parsons, who was a close friend of McMillan’s.
The 20-year-old was a senior at Indiana University and a part of the sorority Zeta Tau Alpha, whose chapter commended her interpersonal skills in a Facebook post.
